How Michigan Law defines Indecent Exposure

‘Simple’ Indecent Exposure:

  • A person shall not knowingly make any open or indecent exposure of his or her person or of the person of another.

‘Aggravated’ Indecent Exposure:

  • If the person was fondling his or her genitals, pubic area, buttocks, or, if the person is female, breasts.

Indecent Exposure by a sexually delinquent person: 

  • Committing either Simple or Aggravated Indecent Exposure while being a previously convicted sexual delinquent can lead to harsher punishments.

Being convicted of simple indecent exposure can result in both criminal penalties and fines. That means up to a year in jail and a fine of up to $1,000. An Aggravated Indecent Exposure charge is a also a misdemeanor but a person can face up to 2 years of jail time. A conviction for indecent exposure by a sexually delinquent person can come with a sentence of up to life behind bars. 

There’s other consequences of a conviction as well. Being convicted of either aggravated indecent exposure or if you have previously been convicted of a sex crime can result in serious punishments. Sex Offender Registration could be mandatory and permanent. 

What is a ‘sexually delinquent person?’

Per Michigan’s Criminal Code Section 750.10a a sexually delinquent person is “any person whose sexual behavior is characterized by repetitive or compulsive acts which indicate a disregard of consequences or the recognized rights of others, or by the use of force upon another person in attempting sex relations of either a heterosexual or homosexual nature, or by the commission of sexual aggressions against children under the age of 16.”
